Introduction

These Terms & Conditions (the Terms) govern your use of the HomeView mobile application (the App). The App is provided by iOpt Limited (iOpt, we, us, our) and made available to you through your housing provider (the Client).

  • The App helps residents view environmental information about their home (e.g., temperature, humidity, air quality), receive guidance, and share optional feedback.

  • The App is can only be accessed with by invitation from your housing provider.

  • Your housing provider is the Controller for personal data processed by the App. iOpt is a Processor acting on the Client’s instructions. For more information see Section 5 and Appendix B.

  • By downloading, installing, or using the App, you agree to these Terms and consent to the processing of your personal data in accordance with these Terms and Controller’s privacy policy.

If you do not agree, please do not use the App. You can request access removal via your housing provider at any time.

Eligibility & Acceptance

We may update these Terms from time to time. We will notify you within the App where appropriate and indicate the “Last updated” date. Continued use after changes means you accept the updated Terms.

The App – Purpose and Scope

The App is provided to you by your housing provider via iOpt and is designed to support your understanding of your home environment and enable you to provide feedback to your housing provider. The key functions are:

  • Display of environmental data linked to your home or property (for example temperature, humidity, CO₂ levels) where sensors have been installed.

  • Collection of optional feedback and survey responses from you (for example on heating habits, drying behaviours, comfort or wellbeing) to help your housing provider monitor property conditions and tailor services.

  • Provision of guidance, tips or informational content (for example on ventilation, condensation, damp & mould prevention, energy-use awareness) to support a comfortable and healthy home environment.

The types of data collected by the App typically include (details in Appendix B):

  • Account & contact information (e.g., email address, name).

  • Property-linked sensor and device data (e.g., temperature, humidity, CO₂, certain device/diagnostic info).

  • Surveys/feedback you choose to submit (e.g., heating habits, drying clothes, comfort levels).

  • Device identifiers and app telemetry (e.g., app version, OS, crash logs).

What the App does not do/your responsibility

  • The App is informational only. It is not a substitute for your tenancy agreement, the repair and maintenance processes of your housing provider, or professional advice (for example relating to safety, structural issues, or health hazards).

  • The App does not constitute an emergency alert system or guarantee detection of hazards or faults in the property equipment or fabric.

  • You are responsible for your use of the App and we have no responsibility for anything you do or do not do based on its use or any information it provides

Roles & Responsibilities

Client (Housing Provider) – Controller: decides what data is collected, why and how long it is kept; manages access to the App; responds to your data rights requests.

iOpt – Processor: provides the App, hosts the platform, and processes personal data on the Client’s instructions.

You – User: are responsible for keeping your account secure, providing accurate information, using the App lawfully, and following acceptable use (Section 9).

Personal Data

Personal data in the App is processed in accordance with your housing provider’s privacy policy.

How the data is used

  • To provide and support the App, enable your access, and present insights to you and your housing provider.

  • To operate, secure, maintain and improve the App.

  • To generate anonymised/aggregated analytics that help identify property patterns without identifying residents (see Section 6).

Anonymisation & Analytics

We support cross-customer analytics without identifying you by removing names, addresses, emails, phone numbers and other identifiers. We retain only archetype attributes (e.g., property type, build era/fabric) to compare building performance and trends. These analytics help housing providers manage homes and improve services while respecting privacy.

Hosting & Security

  • The platform is hosted in the United Kingdom (AWS UK region).

  • We use industry-standard security measures including encryption in transit and at rest, role-based access control, monitoring, and regular backups.

  • We may engage vetted sub-processors (e.g., cloud and support providers). A current list is available on request from your housing provider. We remain responsible for their performance related to the App and its processing of your personal data.

Hosting & Security

You agree that you will not:

  • misuse the App or attempt to bypass security or access another person’s data;

  • upload content that is unlawful, defamatory, discriminatory, infringing, or harmful (including malware);

  • upload images or documents that contain personal data of other people

  • reverse engineer, copy, or create derivative works from the App except as permitted by law;

  • use the App for advertising or commercial purposes.

If you submit feedback or content, you grant iOpt a non-exclusive right to use it to operate and improve the App (without identifying you) unless otherwise agreed.

Service Availability & Support

  • The App may be unavailable from time to time for maintenance, updates, or issues outside our control (e.g., mobile networks, internet providers).

  • We aim to provide reasonable support via in-app help, email or the Client’s resident services. Contact details are in Appendix C.

Disclaimers

  • The App is provided for information only. It is not intended to diagnose issues, guarantee building performance, or provide professional advice. Always report repairs and emergencies via your housing provider’s usual channels.

  • Environmental indicators (e.g., for damp & mould) are based on sensor data and models and may not capture every scenario.

Limitation of Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be limited.

To the fullest extent permitted by law:

  • iOpt will not be liable for indirect or consequential losses, loss of data, loss of use, or loss of profits.

  • iOpt’s total liability to you for the App will be limited to £100 (one hundred pounds) or the minimum amount permitted by law if higher.

  • Your housing provider remains responsible as Controller for data protection matters and for decisions about how resident data is used.

Suspension & Termination

We or your housing provider may suspend or end your access if: (a) you breach these Terms, (b) your access code expires or your tenancy ends, or (c) the App or related services are withdrawn. On termination, your right to use the App ends.

Intellectual Property

The App and all related software, content and materials are owned by iOpt or its licensors. We grant you a personal, non-exclusive, non-transferable licence to use the App on your device for its intended purpose while you are authorised by your housing provider. All other rights are reserved.

Changes to the App

We may change or update features to improve performance, security, or usability. Where changes materially affect how the App works for you, we will notify you where appropriate.

Fees

Residents are not charged to use the App. Any subscription or licensing is between iOpt and your housing provider.

Governing Law & Jurisdiction

These Terms are;

(a) If you live in Scotland governed by the laws of Scotland and the Scottish courts will have jurisdiction;

(b) if you live in England or Wales, governed by the laws of England and Wales and the courts of England and Wales will have jurisdiction.

This does not affect any mandatory consumer protections that apply where you live.

General

  • If any part of these Terms is found invalid, the rest remains in effect.

  • We may transfer our rights and obligations under these Terms to another organisation; this will not affect your rights.

  • Delay in enforcing these Terms does not remove any rights we may have.

  • These Terms work alongside your tenancy agreement and your housing provider’s policies.

Appendix A – Definitions

  • App: the iOpt Home View mobile application provided to residents via their housing provider.

  • Client / Housing Provider: your landlord or social housing provider administering access to the App, and the Controller for personal data.

  • Controller: the organisation that decides why and how personal data is processed (your housing provider).

  • Processor: an organisation that processes personal data on the Controller’s instructions (iOpt).

  • Personal Data: information relating to an identified or identifiable person.

  • Anonymisation: removal of all identifying information from a data set to irreversibly prevent identification.

Appendix B – Personal Data Categories and Rights

Categories of personal data (may vary by Client configuration):

  • Account & Contact: email address; name (if supplied by Controller); access code; tenancy/property identifier (Controller-managed).

  • Sensor/Device: temperature, humidity, CO₂ (where available), device diagnostics, timestamps.

  • Usage/Telemetry: app version, OS, crash/error logs, device ID, IP at time of connection.

  • Surveys/Feedback: heating habits, drying clothes, comfort levels, free-text comments.

  • Optional Media: photographs for property assessments (subject to safeguards).

Controller and iOpt work together to support your data protection rights, as described in Controller’s privacy notice.
